Frank Haber – Independent Psychologist
1. Scope
These General Terms and Conditions apply to all services, contracts and offers provided by Frank Haber, independent psychologist (hereinafter “Provider”), in the field of consulting, training, coaching and awareness campaigns, particularly within the international higher education sector.
Deviating terms of the client shall only apply if expressly agreed in writing.
2. Services
(1) The Provider offers in particular:
Individual consultations
Coaching
Trainings (online or on-site)
Awareness campaigns
Organizational consulting
(2) Services may be provided to individuals or organizations.
(3) The Provider may involve external experts from a professional network to deliver services.
There is no employment relationship, no authority to issue instructions, and no partnership relationship between the Provider and these external experts. They act independently and on their own responsibility.
(4) Unless explicitly agreed otherwise, the Provider owes the service itself but not a specific success.
3. Conclusion of Contract
(1) A contract is concluded through individual agreement during an initial consultation or written confirmation (including email).
(2) Scope of services, fees and special conditions are agreed individually.
4. Fees and Payment Terms
(1) Services are billed based on:
hourly rates, or
daily rates
(2) Fees are individually agreed upon with the client during the initial discussions.
(3) Additional costs may be charged, including:
travel expenses
accommodation costs
other necessary travel-related expenses
(4) Invoices are payable within 14 days unless otherwise agreed.
(5) Statutory provisions apply in case of late payment.
5. Cancellation Policy
(1) Individual appointments may be cancelled free of charge up to 48 hours before the scheduled time.
(2) Later cancellations may result in full or partial billing of the agreed fee.
(3) Specific cancellation terms for trainings or events may be agreed individually.
6. Client Cooperation
The client shall provide all necessary information in a timely manner and ensure appropriate organizational conditions for service delivery.
7. Liability
(1) The Provider shall be liable without limitation in cases of intent or gross negligence.
(2) In cases of slight negligence, liability is limited to breaches of essential contractual obligations and to foreseeable, typical damages.
(3) The Provider assumes no liability for decisions or measures taken based on the consultation or training.
8. Confidentiality
The Provider shall maintain confidentiality regarding all information obtained during the professional engagement unless disclosure is legally required.
9. Data Protection
Personal data is processed in compliance with applicable data protection laws, in particular the GDPR.
10. Copyright
All materials, concepts and documents provided remain protected by copyright and may not be reproduced or distributed without explicit permission.
11. Applicable Law and Jurisdiction
German law shall apply.
Place of jurisdiction, where legally permissible, is the registered office of the Provider.
